Plaintiffs in error were plaintiffs and the-defendants in error were defendants in the trial court, and we will so designate the-parties.

Plaintiffs filed this suit in the district court of Montgomery county, Tex., in the-form of trespass to try title and for dam ••ages for oil produced and removed from a tract of 826 acres of land, a part of the Ransom House one-third league and labor. The land involved, known as the Madeley 826-acre tract, is in the Conroe oil field and is very valuable. By stipulation on the trial, the matter of accounting for the -oil which has been produced…
