The plaintiff in error, hereinafter called defendant, was convicted in the county court of Noble eounty on a charge of selling intoxicating liquor and sentenced to pay a fine of $200 and to serve a term of 90 days in the county jail. The conviction is based upon the evidence of the witness Glenn Eales, who testified that he purchased a bottle of whisky from defendant at his home and paid $2.50 for it, and that the purchase was made in the presence of a woman whom he took to be defendant’s wife.
