It is contended by counsel for plaintiff in error that the district judge erred in refusing and denying the application for a temporary injunction, and this contention is based upon two grounds, viz.: first, that the action of the county board in ordering an election to determine the location of the county seat of Grant county was an appealable one; that an appeal was regularly and legally taken, and that such appeal should act as a super-sedeas and, therefore, the temporary injunction should have been granted; second, that the order of the commissioners…
