This case was before this court at December term, 1855. It is reported as then presented, in 13 Howard, p. 250. The judgmént of the Circuit Court was reversed, and the cause remanded for further proceedings. The action below was ejectment, brought to recover a part of the land formed by accretion on the shore of Lake Michigan, north of the north pier of the harbor, in the city of Chicago. The land in controversy was claimed to belong to water lot No. 34, in Kinzie’s addition to that city. The plaintiff in error sought to recover it, in virtue of his ownership of that lot.
