This is a workmen’s compensation case wherein the trial judge found against the petitioner on the ground that he was not an employee of the defendant. An appeal was seasonably prayed and granted to this Court.

At the time of the alleged injury herein the petitioner was an ice cream peddler selling- at retail products manufactured by the defendant company. On June 8, 1957, while pushing an ice cream cart on the streets of Memphis the petitioner was run into by an automobile and injured. He is a 66 year old unskilled man who has been peddling the defendant’s products in pushing one of its carts…
