Appellant, the Honorable James P. MacElree, II, appeals from a judgment of the superior court which affirmed an order of the Court of Common Pleas of Philadelphia County. The court of common pleas sustained preliminary objections in the nature of a demurrer filed by appellees, Philadelphia Newspa*120pers, Inc. and B.J. Phillips, and dismissed appellant’s complaint with prejudice.2 We granted review to address the issue of whether the lower courts erred in determining as a matter of law that the complaint failed to state a cause of action.
