(dissenting) : In the Town of Hartsville, Darlington County, on April 5, 1930, James Nelson, a messenger boy for the Western Union Telegraph Company, while riding a bicycle, collided with a pedestrian, E. U. Blackwell, and, as a result of that collision, Blackwell died on April 17th. Following his death letters of administration were taken out and two suits were brought against the telegraph company and James Nelson; one for pain, suffering, and expenses, and the other for wrongful death.
