This suit was brought in the Court of Common Pleas for Dillon County to recover damages for the death of plaintiff’s intestate and resulted in a verdict for the plaintiff. A motion for a new trial was made and the trial Judge granted the motion upon the sole ground that he had committed an error in charging the jury as to what constituted a traveled place, purely a question of law. From this order the plaintiff appealed, alleging error in granting the new trial and contending that the law was properly charged.…
