Before the Court is Defendants’ Motion to Dismiss for Lack of Subject Matter Jurisdiction (Docket No. 18), or, in the alternative, Defendants’ Motion to Dismiss for Failure to State a Claim (Docket No. 19). Also before the Court is Valley County’s Motion to Intervene (Docket No. 13).
