MEMORANDUM OPINION AND ORDER

Plaintiff Catherine A. Kruger (“Plaintiff’) filed a four-count complaint against defendant Anthony J. Principi, Secretary of the United States Department of Veteran Affairs (“Defendant”), pursuant to 42 U.S.C. § 2000e-16(c). Count I alleges the United States Department of Veteran Affairs (“VA”) retaliated against Plaintiff in violation of the Rehabilitation Act, 29 U.S.C. § 794.
