GIERKE, Justice.

Eberhart Moving and Storage, Ltd. appeals from a District Court judgment affirming the Worker’s Compensation Bu*149reau’s order revoking a prior dismissal and order granting employee status to Mack Griffin. We affirm.

Griffin was employed as a truck driver by Eberhart in March, 1986 and terminated his employment by May, 1987. Eberhart then offered him work as an “independent contractor/driver”. The parties executed an Owner/Operator Agreement on August 7, 1987, and worked under this agreement until June 24, 1988, when Griffin sustained a work-related injury in the state of Indiana.…
