*622In an action to recover damages, inter alia, for breach of contract and fraud, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Pitts, J.), dated March 24, 2008, which granted the motion of the defendants to dismiss the complaint and compel the plaintiff to arbitrate and denied its cross motion to compel discovery.
Ordered that the order is modified, on the law, by (1) deleting the provision thereof granting that branch of the defendants’ motion which was to dismiss the complaint, and substituting therefor a provision denying that branch of the motion, (2) deleting the…
