Plaintiff in error, hereinafter called defendant, was convicted in the district court of Pon-totoc county of the crime of manslaughter in the first degree, and his punishment fixed by the jury at imprison ment in the state penitentiary for a period of four years, with a recommendation that the sentence be suspended.
The evidence of the state was that Luke McNair, the deceased, Bob’ Beeves, Jennings Burris, Houston Munsey, Bob Walker, and Tom Cook were drinking and gambling near defendant’s home on the day of the homicide; that as the others left, defendant and deceased continued to gamble;…
