CUMMINGS, Circuit Judge.

Tariq Shahid was indicted on charges of being a felon in possession of a firearm and being a felon in possession of ammunition, both in violation of 18 .U.S.C. § 922(g)(1). He filed a motion to suppress the firearm and the ammunition, alleging that they were discovered incident to a stop by shopping mall security officers that violated the Fourth Amendment. After an evidentiary hearing, the district court denied the motion to suppress, concluding that the Fourth Amendment did not apply because the mall security officers were not acting as agents of the government.
