Claimants, who are husband and wife, at all times herein mentioned, were the owners of a parcel of land with a dwelling and other structures located thereon, consisting of 80 acres, more or less, situate in the town of Southport, county of Chemung, New York. At all times herein mentioned, Seeley Creek, a nonnavigable stream, flowed in a general northerly direction through claimants’ land, dividing it into a parcel of 35 acres westerly and 45 acres easterly thereof.
