This is a simple action to recover a balance of deposit in the sum of $668.77, and interest thereon.

The plaintiff was a depositor in the Bank of United States, and on December 10, 1930, had on deposit in the said named institution, subject to withdrawal upon his order, the sum of $2,660. On that day he called upon the defendant and spoke to its assistant manager in charge of opening accounts, one Juchter; he informed him that he was a depositor in the Bank of United States; that he* had heard unfavorable rumors regarding its solvency and, therefore, wished to withdraw his money on deposit…
