While vacationing in Bermuda in June, 1984, the plaintiffs, New Jersey residents, and the defendant, a Massachusetts resident, were involved in a moped collision. The plaintiffs brought an action for negligence against the defendant in Massachusetts. Claiming that Bermuda was the more appropriate and convenient forum in which to conduct the litigation, the defendant sought dismissal of the complaint.
