I. INTRODUCTION

On June 11, 1993, Plaintiff Homer McClarty, on behalf of the bankruptcy estate of Debtor Maridarlene Fortney, filed a one-count complaint against Defendants, Dale Gudenau, Esq., and his law firm, Sullivan, Ward, Bone, Tyler & Asher, P.C.
