MEMORANDUM OPINION AND ORDER

Plaintiff Willie Crumpton commenced this action in state court against Defendants Philip Morris, USA (“PM”) and Donald Willis, asserting claims for (1) racial discrimination under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §§ 2000e-16, (“Title VII”) and the Colorado Anti-Discrimination Act of 1957, Colo.Rev.Stat. 24-34-301 to -915, (2) fraud by deceit, (3) intentional infliction of emotional distress and (4) tortious interference with contractual rights.
