A motion was made to dismiss the writ of error, upon the ground that the bill of exceptions did not specify the judgment complained of, and such judgment had not been sent up as a part of the record. The bill of exceptions recites, that the defendant demurred to the petition as amended, and that, after hearing argument, the court sustained the demurrer and dismissed the petition.
