This action was commenced by Thomas Nelson, herein termed “plaintiff,” against Edward Reinhart', herein termed “defendant,” primarily to recover a money judgment for the sum of $1,522.50, alleged to be the balance due upon an accommodation loan of $2,500, made to the defendant in the year 1909, but, when the pleadings were settled, the case was tried before a jury upon the general issue raised by plaintiff’s reply or answer to defendant’s counterclaim, in which he admitted the indebtedness, and set up that in June, 1912, the defendant, at the special instance and…
