The action is brought to recover commissions earned by the plaintiff by procuring a purchaser for what was known as the lower-ferries belonging to the defendants and other persons. The defendants had inherited from their ancestor the right to operate and were conducting two ferries, one known as the Fourteenth Street or upper ferry, which extended from Fourteenth street, in Hoboken,, to Fourteenth street, in New York, and the other known as the-lower ferry, extending from Newark street, in Hoboken, to Christopher and Barclay streets, in New Fork.
