Petitioner, William Max Burns, was arrested on March 29, 1961, by officers of the Los Angeles Police Department for an alleged violation of section 192 of the Penal Code and lodged in the Los Angeles city jail. On the same day he was released from custody on a writ of habeas corpus and upon posting a bail bond in the sum of $1,050. The undertaking recited his booking number and that he was to be held upon a charge of violation of section 192, subdivision 3, of the Penal Code.
