MEMORANDUM OPINION
MICHAEL, Senior District Judge.
On February 12,1997, United States Magistrate Judge B. Waugh Crigler conducted a hearing on defendants’ motion for summary judgment pursuant to Fed.R.Civ.P. 56. In an Order incorporating findings made from the bench, the Magistrate recommended dismissal of Plaintiff Frank D. Shiflett’s claims under the Americans with Disabilities Act (“ADA”), 42 U.S.C. § 12101 et seq. and plaintiffs claim under Virginia state law for negligent infliction of emotional distress.
