Plaintiff brought this action alleging a breach of contract claim against defendant The Bank of New York (bank) on the ground that the bank had charged her for taxes and fees that had not been incurred with respect to a deed of trust on plaintiffs property. Plaintiff also sought an accounting and asked the court to enjoin the scheduled foreclosure on her property by the bank and its servicing agent, defendant HomEq Servicing Corporation (HomEq).
