This is an original proceeding in prohibition. The pleadings in the case, the petition, return and reply, disclose the following facts:

On or about June 11, 1923, one Dee Pickett, filed in the Circuit Court of Jackson County a petition in mandamus entitled: “State of Missouri at the Relation of Dee Pickett, Relator, v.
