OPINION

BLISS, Presiding Judge:

In the District Court of Oklahoma County, Case No. CRF-72-194, appellant, Samuel C. Hawkins, hereinafter referred to as defendant, was charged, tried and convicted for the offense of Attempted Burglary in the First Degree. His punishment was fixed at five (5) years imprisonment. From that judgment and sentence, á timely appeal has been perfected to this Court.
