NIX, Judge.

Glen Estill Music, plaintiff in error, hereinafter referred to as defendant, was charged by Information in the County Court of Caddo County with the crime of Driving a Motor Vehicle While Under the Influence of Intoxicating Liquor. He was tried by a jury, found guilty, and his punishment assessed at $100.00 fine and 30 days in the county jail. From that judgment and sentence defendant filed his appeal in this Court within the time prescribed by law. It will be necessary to briefly outline the facts of the case.
