NIX, Judge.

Raleigh Goldrige Ervin, hereinafter referred to as the defendant, was charged by information in the District Court of Oklahoma county with the crime of attempted burglary in the 2nd degree after former conviction of a felony. A jury found the *403defendant guilty, but was unable to agree upon the punishment, and left the punishment to be affixed by the court. The trial judge sentenced the defendant to serve a period of four (4) years in the Oklahoma State Penitentiary.
