OPINION. BAKER, Judge.
Today we examine the trial court's interpretation of Ind.Code § 8-1-2.2-8(d), the statute involving a municipality's authority to appoint a commissioner for its electric power and energy needs. Appellants-defendants Indiana Municipal Power Agency (the Agency) and The Indiana Municipal Power Agency Board of Commissioners (the IMPA Board), appeal the trial court's grant of summary judgment entered in favor of the appellee-plaintiff, Town of Edinburgh (Edinburgh).
