Affirming.

This appeal is from a judgment in two actions, between the same parties, the actions having been consolidated. From the judgment, there is an appeal and, also, *524a cross-appeal. The decision must be rested upon the construction to be placed upon a certain clause of' the will of Agnes Flournoy, and a clause of the codicil to-her will. The will was executed on February 9, 1838, and the codicil, on July 18, 1840, and both were probated as her last will and testament on August 17, 1840.
