OPINION

This is an appeal from an order of the district court denying appellant’s motion to vacate the portion of a divorce decree that granted respondent custody of his children.

Appellant Maryann Swan (Maryann) and respondent Richard Swan (Richard) married and lived in Utah until their separation in September 1986. In January 1987, Richard moved to Nevada, while Maryann stayed with the children in Utah. On September 28, 1987, Richard filed a complaint for divorce.
