This is an action on the case, brought in the circuit' court for the county of Wayne, under sections 2268 and 2269 of HowelPs Statutes, being Act No. 92 of the Public Acts of 1877 of the State of Michigan, which provides—

“That every person who shall by himself, or by any •clerk, servant, agent, or employé, sell, give, or furnish, ■or cause to be sold, given, or furnished, any intoxicating, .spirituous, malt, brewed, or fermented liquors, cider or wine, or any liquor or beverage any part of which is intoxicating, spirituous, malt, brewed, or fermented, to any minor under the age of 18 years,…
