On September 25, 1995, Melvin Burgess died as a result of injuries he sustained in a drunk driving accident nine days before. At the time of the accident, Mr. Burgess was ' covered by a life insurance policy for $100,-000 which he purchased from J.C. Penney Life Insurance Co. Mr. Burgess’ sons, as beneficiaries of this life insurance policy, sought to recover the benefits from J.C. Penney as a result of their father’s death. J.C.
