On June 9, 2003, Plaintiff filed this action against Defendant Castworld Products Inc. (“Defendant”), after Defendant was identified by the United States Bureau of Customs and Border Protection (“Customs”) as the importer of 8,000,000 counterfeit MARLBORO® and MARLBORO Red Label® cigarettes in violation of state and federal laws.
