MEMORANDUM OPINION AND ORDER

ALESIA, District Judge.

Before the court are three motions for summary judgment by defendants in this case: one by defendant Michael Oberst (“Ob-erst”); one by defendant Kemper Corporation (“Kemper”); and one by defendants Prime Group, Inc. (“Prime Group”), and Prime International, Inc. (“PH”) (collectively, “Prime defendants”), who also adopt Kem-per’s motion. For the reasons that follow, the court strikes Oberst’s motion as moot and -grants the remaining defendants’ motions.
