Several exceptions were reserved during the trial to the ruling of the court upon the admission of testimony. The first of these relates to the court’s refusal to exclude the answer of witness Pomeroy to certain questions propounded to him'. The motion to exclude was upon the single ground that these answers assumed that Beeves, the purchaser of the goods from plaintiff, had failed in business.
