MEMORANDUM OPINION

DAUGHERTY, District Judge.

In this case the Plaintiff Frank J. Hunter sues the Defendants Missouri-Kansas-Texas Railroad Company (Katy Railroad) and St. Louis-San Francisco Railway Company (Frisco Railway) for damages as a result of personal injuries received by him on September 11, 1963, while unloading a railroad hopper ear at a railroad siding at the bulk cement plant of Halliburton Company situated in Cushing, Payne County, Oklahoma. The Plaintiff has previously recovered Oklahoma Workmen’s Compensation benefits from the Halliburton Company. The case at bar is a…
