OPINION
NETTESHEIM, Judge.
This is a suit for temporary, preliminary, and permanent injunctive relief and a declaratory judgment restraining the Federal Aviation Administration (the “FAA”) from awarding a contract to any bidder other than plaintiff Essex Electro Engineers, Inc. (“Essex”), declaring that Essex is entitled to award of the contract, and directing the FAA to award the contract to Essex.1 The parties have cross-moved for summary *279judgment on the merits, and a hearing has been held.
