KERR, District Judge.
This is a Title VII action instituted under the provisions of 42 U.S.C. §§ 2000e-2, 2000e-3. The material facts are not in dispute and may be summarized as follows:
Plaintiff Abraisto Vincent Romero, a Mexican-American, became an employee of Union Pacific Railroad Company on October 9, 1975 as a laborer in the Laramie panel yards, Laramie, Wyoming.
