The defendant appeals a decision of the Superior Court (Dunn, J.) granting the plaintiff’s motion for summary judgment, which required the defendant to indemnify and defend the plaintiff in an action for personal injuries. We affirm.

In January 1983, the intervenor, Cablevision Service Company (Cablevision), contracted with Public Service Company of New Hampshire (PSNH) and New England Telephone and Telegraph (NET) to use their jointly owned telephone poles to carry television cables to several communities in New Hampshire.
