DENMAN, Circuit Judge.

This is an appeal from an order of the District Court denying to appellant, Carey Smith, a writ of habeas corpus. The appel*261lant grounds his petition for a writ upon the contention that he is being unlawfully deprived of his liberty by appellee, Swope, Warden of the United States Penitentiary at McNeil Island, Wash.
