DONOFRIO, Judge.

This is an appeal from an order and judgment granting a motion to set aside the default judgment against a surety on a replevin (redelivery) bond.

Appellant, plaintiff below, a member of the Arizona Bar, on August 14, 1964, filed an action for attorney’s fees in the amount of $3,501.19 against R. O. Kelly and Romería Kelly, Kelly Development Co. Inc., Kelly Enterprises Inc., and Marks Inc.
