I. INTRODUCTION

Cordis Corporation (“plaintiff’) filed this patent infringement action against Boston Scientific Corporation and Boston Seimed Inc. (“defendants”) on October 17, 2008 following defendants’ announcement that they had received FDA approval for their drug-coated coronary stent, the Taxus Liberté. (D.I. 1) Plaintiff asserted causes of action for infringement of claim 2 of U.S. Patent No. 5,895,406 (the “Gray patent”) and for a declaratory judgment of infringement of the Gray patent, based upon defendants’ pre-launch activities.
