Walker, J.), entered July 13, 2010, which, insofar as appealed from as limited by the briefs, denied defendants’ motion to dismiss the complaint pursuant to CPLR 3211 (a) (2), unanimously reversed, on the law, without costs, and the motion granted. The Clerk is directed to enter judgment in favor of defendants dismissing the complaint.
