This is an appeal by Robert Edward Cabaniss from an order of the Circuit Court of Prince George County, entered on December 6, 1963, denying and dismissing his petition for a writ of habeas corpus, by which he sought release from a sentence of ten years imposed by the Circuit Court of Prince George County on January 7, 1963 (Holladay, J., presiding) for rape.
