ANDERSON, Presiding Judge.
The plaintiff, Carter J. Briley, brought this action under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51, to recover damages for personal injuries alleged to have been sustained by him on October 20, 1950, during the course of his employment, and due to the negligence of defendant’s agent and servant. The trial below resulted in a verdict and judgment for plaintiff in the sum of $15,000. The trial court ordered a remittitur of $5,000, which remit-titur was made. Defendant’s motion for new trial being overruled, defendant appealed to the Supreme Court.
