RULING ON DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT

POLOZOLA, District Judge.

On March 31,1989, John Henry Brossette, the owner and operator of the Old Five Crown Social Club, was served with a notice issued by the Alcoholic Beverage Control Board (ABCB) stating that Brossette had violated Baton Rouge Ordinance 8787, Section 6.A.K10). 1 Specifically, Brossette was charged with operating his establishment in a manner reasonably anticipated to have an adverse effect on the public health, safety or morals.
