The defendant was charged with the murder of his wife by causing her to take deadly poison, and was convicted of murder in the second degree.

The defendant excepted to the order of the court that a recess of two weeks be taken, based on motion of the district attorney made on the day set for trial, after the list of jurors had been called but before any of them had been examined. The reason for the motion, as stated by the district attorney, was, that he had not been able to obtain the attendance of an officer who was a material witness and who was away on important business.
