The evidence in this case, including a con*275fession, warranted a finding of the following facts. The defendant’s wife died on March 30, 1935, after a lingering illness, leaving the defendant and their only child, Anthony, a married man of twenty-three years. The defendant was engaged in a retail business which was practically managed by one Ethel Reilly, to whom, about a month after the death of his wife, he became engaged to be married.
